The FTC Statement indicates that when a person dies, creditors have the right to collect on theperson’s debts from the assets of his or her estate. To balance the interests of both consumers and creditors, the Statement clarifies how collectors can comply with the law. Notably, the FTC encourages all collectors to check the records of the probate courts to ensure contact with the right party.
